The Influence of Feiz Kashani's Views on the Formation of Islamic criminal Law

Islamic Criminal law being passed currently based on the view of famous jurists has articles related to the four major sections of general laws, punishment, retaliation or Qisas, and Hadd. In passing laws, the lawmaker sometimes uses less common Fatwas and jurisdictions. In many of his works, Feiz has advocated views radically different from those of other jurists, even though his expertise is not limited to jurisprudence. His views are based on quranic verses and traditions, advocate unity among Islamic scienes, and conform to the demands of the social setting. The present article tries to explore the aspects of the use of Feiz,s less common and sometimes unique views in the curren reconsiderations of Islamic criminal law. As a full discussion of the topic is beyond the scope of the present article, only the articles related to Islamic Hadd are explored in the light of Feiz Kashaniıs views.
